Modern Agent Institute Affiliate Program – Terms of Service
Effective Date: June 3, 2025
1. Agreement
By enrolling in the Modern Agent Institute Affiliate Program (“Program”), you agree to abide by the following Terms of Service (“Terms”). These Terms outline your rights and responsibilities as an affiliate.
Modern Agent Institute (“we”, “us”, “our”) reserves the right to revise or update these Terms at any time without prior notice. Updates may include changes to tools, resources, or program features. Continued participation after such updates constitutes acceptance of the revised terms.
Violating these Terms may result in termination of your affiliate account and forfeiture of any pending commissions earned during the violation period. You agree to use the Program at your own risk.
2. Account Requirements
- You must be a real person. Automated or bot-generated accounts are prohibited.
- You must provide accurate and complete information, including your full legal name, email address, and any other required details during registration.
- You are solely responsible for keeping your account and password secure.
- You are responsible for all content and actions under your affiliate account.
- Each individual or business may maintain only one affiliate account.
- You must not use the Program for unlawful purposes or in violation of any applicable laws, including intellectual property laws.
3. Use of Affiliate Links and Materials
Upon acceptance into the Program, you will receive a unique affiliate ID and access to banners, links, and marketing materials. You may place these materials on your website, emails, or social media as long as they include your designated affiliate ID.
To track commissions accurately, you must use the proper tracking link formats provided by us. Commissions are only earned on referrals generated through these correctly formatted links. We are not responsible for commissions lost due to improperly used links or incorrect affiliate IDs.
4. Commissions and Payments
- Commissions are earned when a user clicks your affiliate link and makes a qualifying purchase or enrollment on https://modernagt.com.
- Commissions are paid monthly on 20th via PayPal or Direct Deposit, provided that your earnings exceed $75.
- Only sales tracked through our affiliate system are eligible for commission payments.
- We reserve the right to withhold or cancel commissions for transactions we deem to be fraudulent, manipulative, or in violation of these Terms.
- If a referred customer cancels, requests a refund, or disputes their payment, the related commission will be revoked.
5. Representation
You may not:
- Misrepresent yourself as an employee, partner, or official representative of Modern Agent Institute.
- Issue public statements (e.g., press releases) implying endorsement or sponsorship without written permission.
- Use your affiliate link for personal purchases. Such activity may result in disqualification from the Program and loss of commissions.
6. Payment Schedule
Affiliates will be paid monthly as long as their account balance exceeds $75. Earnings below this threshold will roll over to the following month.
7. Customer Ownership
All customers referred through the Program are considered customers of Modern Agent Institute. As such, our standard terms, privacy policies, and procedures govern all transactions and customer relationships.
8. Affiliate Responsibilities
You are solely responsible for:
- Developing, maintaining, and operating your website or promotional content.
- Ensuring your content and promotions are compliant with laws and third-party agreements.
- Truthful and non-infringing use of our materials.
- Clearly disclosing your affiliate relationship with Modern Agent Institute where required by law.
You must also ensure that your content:
- Does not infringe on intellectual property rights.
- Is not defamatory, offensive, or illegal.
- Includes a privacy policy if you collect user data, disclosing how data is used and stored.
9. Legal Compliance
You agree to comply with all local, state, and federal laws applicable to marketing and advertising, including the CAN-SPAM Act and all anti-spam regulations.
10. Term and Termination
This Agreement begins upon our acceptance of your application and remains in effect until terminated by either party. Either party may terminate this Agreement at any time, for any reason.
Upon termination, you must immediately:
- Remove all affiliate links and materials from your website or marketing channels.
- Stop representing yourself as an affiliate.
We may withhold final payments if we determine your account violated these Terms.
11. Program Termination
We reserve the right to terminate the Affiliate Program at any time. If the program is discontinued and your account is in good standing, we will pay any earned commissions above $50.
12. Relationship of Parties
You are an independent contractor. Nothing in this Agreement creates a partnership, agency, or employment relationship. You have no authority to make statements or commitments on behalf of Modern Agent Institute.
13. Limitation of Liability
We are not liable for any indirect, special, or consequential damages related to your participation in the Program. Our total liability will not exceed the total commissions paid to you under this Agreement.
14. Disclaimer
We make no warranties about the Program, including its availability, performance, or any products sold. Participation is at your own risk.
15. Independent Evaluation
By enrolling, you confirm that you:
- Have independently reviewed and accepted these Terms.
- Understand we may independently solicit customers or operate competing programs.
16. Arbitration and Legal Disputes
Any disputes under this Agreement will be settled by confidential arbitration under American Arbitration Association rules. Exceptions include our right to seek legal action for IP violations in appropriate courts.
No class-action or group arbitration proceedings are permitted under this Agreement.
17. Governing Law
This Agreement is governed by the laws of the United States. You may not transfer or assign your rights without our written approval. This Agreement constitutes the full understanding between both parties.
